This Privacy Notice describes the types of information Spectio, Inc. (“Spectio”, “we” or “us”) may collect from you or that you may provide when you visit the website www.spectio.com (the “Website”), use our platform products and services (the “Platform Services"), and in the usual course of business, such as in connection with our sales and marketing activities (collectively, the “Spectio Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. It also contains information about your choices and privacy rights. Please read this Privacy Notice carefully to understand how we will treat your information. This Privacy Notice may change from time to time (see Changes to Our Privacy Notice) so please check this page periodically for updates.

Our Services

We provide the Platform Services to our customers and users (collectively, “Customers”) under an agreement with them and solely for their benefit and the benefit of personnel authorized to use the Platform Services (“Authorized Users”). Our processing of such information is governed by our agreement with the relevant Customer. This Privacy Notice does not apply to (i) the information that our Customers upload, submit or otherwise make available to the Platform Services and other information that we process on their behalf as defined in our agreement with the Customer; or (ii) any products, services, websites, or content that are offered by third parties or that have their own privacy notice. 

Information We Collect About You

Information that we collect from or about you includes information you provide, information we collect automatically, and information we receive from other sources.

Information You Provide

When using the Spectio Services, we may collect certain information, such as your name, postal address, e-mail address, telephone number, job title, company name, or any other identifier by which you may be contacted online or offline ("personal information"). We may also collect information that you provide through your interactions with us, for example, if you request information about our Platform Services, contact our customer success team, interact with our sales team, or participate in marketing activities. 

When you create an account, for example, through the Website or register to use our Platform Services, we may collect your personal information, such as your name and contact information. 

Information We Collect Automatically

We may use standard automated collection tools, such as cookies, web beacons, and similar tools, to collect information about how visitors use the Spectio Services. For example, when you visit our Website or use the Platform Services, we may collect certain information from you or your device. This may include information about your computer or device (such as operating system, device identifier, browser language, and Internet Protocol (IP) address), and information about your activities on our Website (such as how you came to our Website, access times, the links you click on, and other statistical information) and your use of the Platform Services.  

The technologies we use for this automatic data collection may include:

• Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website or use certain functionality within the Platform Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system may issue cookies when you direct your browser to our Website or the Platform Services.
• Web Beacons. Pages of our Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Spectio, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
• Other Identifiers. Our Website uses Google Analytics, a web analytics service provided by Google, Inc. Google Analytics makes use of cookies to help Spectio analyze how users use our Website. The information generated by the cookies about your use of our Website (including your IP address) and collected through Google Analytics (“Google Analytics Data”) may be transmitted to and stored by Google on servers in the United States. Google will use the Google Analytics Data on behalf of Spectio for the purpose of evaluating your use of our Website, compiling reports for Spectio on our Website, and providing other services to Spectio relating to the Website activity and internet usage. Google may also use Google Analytics Data collected to contextualize and personalize the ads of its own advertising network. You can opt-out of Google’s collection and use of the Google Analytics Data by downloading and installing the browser plug-in available under https://tools.google.com/dlpage/gaoptout.

When you use the Spectio Services, we may automatically collect information about how you are using such services (“Usage Data”). While most Usage Data is not personal information, it may include information about your account (such as User ID, email address, or Internet Protocol (IP) address) and information about your computer or device (such as browser type and operating system). It may also include information about your activities within the Spectio Services, such as the pages or features you access or use, the time spent on those pages or features, search terms entered, commands executed, and other statistical information relating to your use of the Spectio Services. We collect Usage Data to provide, support and operate the Spectio Services, for information security purposes, and to better understand how our Authorized Users and Customers are using the Spectio Services to improve our products and services.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

• To present our Website and its content to you;
• To provide you with information, products, or services that you request from us;
• To provide you with customer service and support;
• To create and maintain your Spectio account;
• To send you notifications about the Spectio Services including technical notices, updates, security alerts, administrative messages and invoices;

• To generate and analyze statistical information about how the Website and the Platform Services are used in the aggregate;

We may disclose aggregated information about our Customers and Authorized Users, and information that does not identify any individual, without restriction.

• To our subsidiaries and affiliates, if any;
• To contractors, service providers, and other third parties we use to support our business;
• To fulfill the purpose for which you provide it. For example, if you give us an email address to use an "email a friend" feature of our Website, we will transmit the contents of that email and your email address to the recipients;

Please note that if you decide not to provide use with certain information, you may not be able to access certain features of the Website or use the Platform Services. 

Opt Out of Marketing

We may periodically send you marketing communications that promote our products and services. You may opt out of receiving such communications by following the unsubscribe instructions in the communication you receive. Please note that we may still send you important service-related communications regarding our products or services, such as communications about your account, service announcements or security information.

Your Privacy Rights

Depending on your place of residence, you may have rights in relation to your personal information. Depending on the applicable data protection laws, those rights may include asking us to provide certain information about our collection and processing of your personal information, or requesting access, correction or deletion of your personal information. You also have the right to withdraw your consent, to the extent we rely on consent to process your personal information. 

If you wish to exercise any of your rights under applicable data protection laws, submit a request by emailing us at privacy@spectio.com. We will respond to requests that we receive in accordance with applicable laws. Spectio may take certain steps to verify your request using information available to us, such as your email address or other information associated with your Spectio account, and if needed we may ask you to provide additional information for the purposes of verifying your request. Any information you provide to us for verification purposes will only be used to process and maintain a record of your request.

Additional Information for Certain Jurisdictions

This section provides additional information about our privacy practices for certain jurisdictions.

California

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”) will require us to provide you with additional information regarding your rights with respect to your “personal information” at such time that Spectio: (i) has a gross annual revenue of over $25 million; (ii) buys, sells, or shares the personal information of 100,000 or more California residents, households, or devices; or (iii) derives 50% or more of its annual revenue from selling California residents’ personal information. 

Other US States

Depending on applicable laws in your state of residence, you may request to: (1) confirm whether or not we process your personal information; (2) access, correct, or delete personal information we maintain about you; (3) receive a portable copy of such personal information; and/or (4) restrict or opt out of certain processing of your personal information, such as targeted advertising (if any), or profiling in furtherance of decisions that produce legal or similarly significant effects. If we refuse to take action on a request, we will provide instructions on how you may appeal the decision. We will respond to requests consistent with applicable law. Other Important Information

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, no security measures are perfect or impenetrable. As such, we cannot guarantee the security of your information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Spectio Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Data Retention

Spectio retains the personal information described in this Privacy Notice for as long as you use the Spectio Services, as may be required by law, as necessary for other legitimate business or commercial purposes described in this Privacy Notice (for example, to resolve disputes or enforce our agreements), or as otherwise communicated by you.

Children's Data

The Website and Platform Services are not directed to children under 18 years of age and Spectio does not knowingly collect personal information from children under 18. If we learn that we have collected any personal information from children under 18, we will promptly take steps to delete such information. If you are aware that a child has submitted such information to us, please contact us using the details provided below.

Changes to This Privacy Notice

Spectio may change this Privacy Notice from time to time. We will post any changes on this page and, if we make material changes, provide a more prominent notice (for example, by adding a notice on the Website landing page). The date the Privacy Notice was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this Privacy Notice to check for any changes. If you disagree with any changes to this Privacy Notice, you should stop using the Spectio Services and deactivate your Spectio account.
